Det er helt i orden, når banker pålægger medarbejdere forbud mod at handle med kryptovaluta privat.
Det slår Arbejdsretten i dag fast i en principiel dom i en sag mellem Finansforbundet og Nordea Danmark/Finanssektorens Arbejdsgiverforening (FA).
I FA, der har ført sagen på vegne af Nordea Danmark, er man meget tilfreds med dommen.
”Kryptovaluta er ikke underlagt myndighedsregulering, og internationale undersøgelser dokumenterer, at kryptovaluta i meget stort omfang misbruges til finansiering af kriminalitet og terror. Med andre ord kan medarbejdere, der privat handler med kryptovaluta, utilsigtet risikere at havne i uetiske, i værste fald direkte kriminelle, situationer,” siger Merete Preisler, advokat og underdirektør i FA.
”Derfor giver det selvsagt god mening med et forbud. Og jeg er meget glad for, at vi nu har Arbejdsrettens ord for, at Nordeas forbud var helt inden for lovens rammer,” understreger hun.
Sagen opstod i vinteren 2018, hvor Nordea Danmark udvidede et koncerndirektiv vedr. handel for egen regning til også at omfatte et forbud mod handel med kryptovaluta.
Finansforbundet, der organiserer ansatte i landets pengeinstitutter, mente imidlertid, at forbuddet lå uden for ledelsesretten. Derfor rejste forbundet sagen i Arbejdsretten.
En sag som Nordea Danmark/Finanssektorens Arbejdsgiverforening (FA) altså vandt.
